Functioning of the non-profit organization (ASBL) FFPE


In accordance with Article 22 of the Statutes of the European Public Service Federation (Federal FFPE), an Institutional Committee is set up within each European Institution, to represent the Institution in federal bodies.
The Institutional Committee "Commission" is represented by the Section "Commission Brussels and Outside Union". In this Committee are also grouped the sections established in the various research centers of the JRC in Ispra, Seville, Geel, Petten and Karlsruhe and the local section of the Commission in Luxembourg, as well as the possible sections FFPE in the executive and regulatory agencies of the Commission.


Article 24 of the same Constitution (Federal FFPE) stipulates that each Committee is the emanation of a General Assembly, unless it is constituted as a non-profit organization with a legal personality in which case it is constituted in the form provided by the law.


The section "Commission Brussels and Outside Union" which represents the Institutional Committee "Commission" with the federal authorities has been constituted since October 2005 in ASBL under Belgian law and governed by the corresponding statutes (the current version is the one published in the Moniteur belge - August 21, 2009).

 

MEMBERS of the ASBL FFPE


The different categories of members of the Association are defined in Title II of the Association's statutes.


May be a member of the Association any natural person working or having worked in the services of the European Commission or one of its offices or agencies whatever its status (retired, official, temporary agent, contract agent, seconded national expert, trainee, etc.).


The association consists of full members, adherent members, honorary members and sympathetic members. Only the effective members enjoy the rights granted by the law and the present statutes.


Adherent members are those who, sharing the objectives and principles of the ASBL, are admitted as such by the Board of Directors acting by a simple majority.

This membership is valid for the duration of the contribution paid. The members receive information about the actions of the non-profit organization and benefit from the services and services provided by the non-profit organization such as: Personal advice, assistance from lawyers, training courses...


The identity of the adherent members is secret and must be protected by the Board of Directors. The list of members remaining and to remain secret can only be known to the President, the Political Secretary, the Secretary General (and his deputy), the Treasurer (and his deputy) and the staff employed by the ASBL or under contract and mandated for this purpose. It may not in any way be transmitted in whole or in part to any person outside the Board of Directors. The Board of Directors may mandate a bailiff to ascertain by consulting the list, the number of members up to date contribution.


Effective members are adhering members who, having submitted a written request or not, have been admitted for this purpose by the Board of Directors acting by a simple majority.


Full membership only belongs to the effective members.

In particular, they have the right to:

> apply as an administrator

> to participate and to have the right to vote at Ordinary and Extraordinary General Assemblies, for all acts of the General Assembly, including:

• the modification of the statutes,

• the appointment of directors,

• approval of accounts and budget,

• granting the discharge to the directors,

• the fixing of membership fees.

 

The CSB - Brussels Section Committee – FFPE


The CSB is made up of the active members of the NPO and members who wish to do so and are invited for this purpose.


The CSB meets at least twice a month at the invitation of the President or a Vice-President and the Political Secretary in case of impediment. Generally the CSB meets every Monday from 13:00 to 14:30 in the premises of the union. It discusses topical issues: negotiations with the administration, preparation and monitoring of union actions, etc.

The Board of Administrators of ASBL FFPE


The Board is appointed every two years by the General Assembly on the basis of applications from full members who declare that they wish to become directors.


The Board meets when convened by the President, whenever the needs of the NPO require it or at the request of a quarter of the directors.


The CA is the decision-making body of the FFPE. He represents the Association in all acts of civil life and is vested with all powers to that effect. He orders the expenses of the Association. In particular, he has standing to sue in the name of the Association, both in demand and in defense. It ensures the execution of the administrative formalities prescribed by the law. He establishes and keeps a regular accounting of all operations and reports to the Annual Meeting, which decides on management. For the setting of the political lines of the FFPE, the CA relies on the orientations formulated by the CSB.

 

Roles within the non-profit organization


The Political Secretary is responsible for the analysis of all current affairs, drafting at the request of the President of political scopes for the attention of the ASBL and to shape the doctrine policy of the ASBL. The Political Secretary organizes the secretariat and coordinates the exempted from the service (with the exception of the President). He (she) organizes the participation to the meetings of consultation, proposes the political orientations to the President and the CSB and ensures the secretariat of the CSB.


The Secretary-General is responsible for all matters relating to correspondence and formalities prescribed by law. He (she) drafts the minutes of the deliberations of the Board, ordinary and extraordinary GAs and maintains the registers.


The President convenes and chairs the Board as the CSB and the General Assemblies.


General Assembly


The General Assembly is composed of all the effective members of the association. It is chaired by the Chairman of the Board of Directors.



The General Assembly is the sovereign power of the ASBL. It has the powers expressly conferred upon it by the law and the present statutes, and in particular the law:

• modify the statutes;

• to exclude a member (staff and honor);

• to pronounce the voluntary dissolution of the association or the transformation of it with a social purpose;

• to appoint and dismiss the directors;

• approve annually the annual accounts and budget;

• approve the rules of procedure and its amendments.
